Terms and Conditions

RXDX is brand owned by DHALLOWS EDUCATION TECH PRIVATE LIMITED. (hereinafter referred to as “RxDx”, “Company”, “we”, or “us”). These Terms and Conditions (“Terms”) govern your use of the RxDx mobile application, website, and related services (collectively referred to as the “Platform”).

Definitions

• Platform refers to the RxDx website, mobile app, and any associated digital services.
• User includes any individual accessing or using the Platform and may also be referred to as “you” or “individual”.

Acceptance of Terms

By registering or using the Platform, you agree to:

• Be bound by these Terms.
• Accept our data handling practices as described in our Privacy Policy.
• Comply with all applicable laws as governed by the jurisdiction of India.

Eligibility and Representation

If you register on behalf of someone else or an entity, you confirm that you are authorized to accept these Terms on their behalf.

Platform Access and Usage

• The Platform is provided on an “as-is” basis without any warranties.
• Your account is tied to your email ID or mobile number and is strictly non-transferable.
• Unauthorized sharing of your login credentials or simultaneous multi-device access may result in suspension or termination.

Permitted Usage

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

• Violate any local or international laws.
• Engage in impersonation or misrepresentation.
• Share confidential user credentials.
• Attempt unauthorized access.
• Distribute malicious content or viruses.

User Accountability

You are responsible for all activity under your account. RxDx is not liable for any harm arising from unauthorized use of your credentials. Any breach or suspected breach must be reported immediately via admin@rxdx.co.in.

Content Standards

Content uploaded or contributed by users must comply with all relevant legal standards and must not:

• Be defamatory, obscene, violent, or discriminatory.
• Infringe upon intellectual property rights.
• Promote illegal activity or impersonation.
• Be commercial in nature or misleadingly appear to be from RxDx.

Ownership and Licensing

You retain ownership of your content but grant RxDx a perpetual, non-exclusive, royalty-free, transferable, and sub-licensable license to use it across our platforms, as per the Privacy Policy.

Purpose and Limitations

RxDx is an educational platform for doctors. It does not provide medical advice, diagnosis, treatment, or consultation services. Content is for informational purposes only and should not be used as a substitute for professional judgment.

Content Validity and Limitations

While we strive to keep medical content updated, medical knowledge evolves rapidly. RxDx content should not be considered exhaustive or authoritative for clinical decision-making.

Subscription and License

• Access to content is limited by your selected subscription plan.
• You are granted a non-transferable, non-exclusive, and revocable license to use the content on a single device at a time.
• RxDx may modify or upgrade the services and notify users where reasonably possible.

Service Availability and Changes

We reserve the right to upgrade, modify, or discontinue any aspect of the Platform at any time. Any changes of critical importance will be communicated with proper justification.

Conduct Rules

Users must abide by rules and policies outlined by RxDx. Violation of these rules may result in suspension or denial of access.

User Promises

By using the Platform, you agree:

• Not to share access credentials.
• Not to transmit harmful software.
• Not to reverse-engineer or modify any part of the services.
• To maintain a compliant hardware and software environment.
• To avoid any form of content or action that infringes legal rights or causes harm.

Additional Responsibilities for Multi-Users

If you are using the Platform on behalf of others (e.g., as an institution or hospital representative), you confirm that you have obtained all necessary consents and rights to share user data, receive usage reports, and ensure compliance.

Educational Purpose Only

The RxDx App is strictly intended for educational and informational purposes. It is not a diagnostic tool, and must not be used for:

• Diagnosing medical conditions,
• Confirming clinical decisions,
• Choosing or administering treatments,
• Situations demanding fail-safe performance (such as emergency or mission-critical environments),
• Any medical decision-making where failure could result in injury or death.

These are considered unauthorized uses, and RxDx strictly prohibits the app from being used for any such purposes. Misuse of the app in this manner may violate applicable medical regulations or laws.

No Clinical Guarantees or Warranties

All content available through the RxDx App or associated platforms is accessed at your own discretion and risk. RxDx does not guarantee the accuracy, completeness, or usefulness of any content and disclaims all warranties related to medical outcomes. For further details, please refer to the section titled No Warranties in our Terms and Conditions.

Live Sessions – Not Medical Advice

RxDx may provide live sessions, webinars, and discussion forums. These are intended for academic learning only and do not substitute for medical advice, consultation, or care.

• You acknowledge that participating in or relying on such sessions does not create any doctor-patient relationship.
• RxDx and guest speakers are not liable for outcomes resulting from misuse or misinterpretation of the content shared during such sessions.

LUser Data Collection & Privacy

RxDx may collect both personal and non-personal data when you:

• Register, subscribe, or create an account,
• Enter contests, surveys, or submit feedback,
• Interact with support or communicate with us.

We may also collect device-specific data (OS version, browser type), IP address, and usage patterns to enhance your app experience. RxDx:

• Does not track your location,
• May use anonymized data for analytics,
• Protects your data per legal standards unless disclosure is legally mandated.

Social Media Engagement & Linking

RxDx permits sharing and linking to our social media or website only in a lawful, non-misleading way. Social media content must:

• Avoid impersonation or false representation,
• Comply with our content standards.

RxDx reserves the right to:

• Remove inappropriate or offensive content,
• Restrict unauthorized linking or embedding,
• Disable or revoke social sharing permissions without prior notice.

User comments posted on our platforms are not endorsed by RxDx. However, we may remove posts containing unlawful, abusive, or misleading content, spam, impersonation, or personal data.

Acceptable Use Policy

RxDx platforms must only be used for lawful and ethical purposes. You agree not to:

• Violate any laws,
• Exploit minors,
• Upload harmful, defamatory, or infringing content,
• Spread spam or malicious code,
• Interfere with the app’s performance or security.

Any attempt to misuse, hack, reverse-engineer, or disrupt services will result in strict action and may lead to prosecution. RxDx reserves the right to monitor, suspend, or terminate access for violations.

Limitation of Liability

RxDx, its officers, employees, and partners shall not be liable for:

• Indirect, incidental, or consequential damages,
• Loss of profits, data, or system failure,
• Damages resulting from unauthorized use of the app.

Your exclusive remedy, if any, is limited to the fees paid (if applicable) during the six months prior to the incident. Use of the RxDx App and its content is solely at your own risk.

Indemnity

By using the RxDx App, you agree to defend and indemnify RxDx and its stakeholders from any legal claims, liabilities, or damages arising from:

• Breach of terms,
• Unauthorized use of the app,
• Violation of third-party rights or applicable laws.

Governing Law and Notices

Except where mandatory local laws override this clause or as specified in jurisdiction-specific addenda attached to these Terms, the usage of the RxDx application shall be governed by and construed in accordance with the laws of India.

Notices and Communication:

Any notices or communications related to these Terms, including updates or modifications, will be provided in written form through one or more of the following methods:

• By RxDx via email (to the email address you have registered with),
• By posting on the official RxDx website,
• Via in-app notifications within the RxDx application.

For email communications, the notice shall be considered received on the date it is sent, as recorded by the transmitting system.

This Agreement represents the entire understanding between you and RxDx concerning the subject matter of these Terms, and supersedes all prior or contemporaneous agreements, representations, or communications, whether oral or written.
